The CFTC and SEC are currently vying for regulatory authority over the cryptocurrency market, with the CFTC's lawsuit proving more effective than that of the SEC. Meanwhile, Senator Elizabeth Warren, who is known for her anti-crypto stance, has introduced a bill aimed at combating money laundering. In your opinion, is cryptocurrency a commodity or a security?

I just read the CFTC's lawsuit against Binance:
CFTC alleges that Binance, while claiming to not allow US citizens to use Binance.com, intentionally facilitated US users' access to the platform to maximize profits. In other words, Binance also banned US users, but did so gradually and not seriously.
The documents show that Binance.com earned $63 million from derivatives trading in August 2020, of which 16% came from the US. By May 2021, Binance's derivative trading income had reached null.14 billion in a single month. While the text does not explicitly state how many US citizens use Binance.com, the lawsuit accuses Binance of prioritizing profits over US regulations. Overall, CFTC is suing over what has happened.
CFTC claims that Binance.com employees instructed US customers on how to access the website through VPNs to avoid being blocked.
Binance US has not yet registered with the CFTC... hmm... Binance US does not have futures trading.
🔥5. CFTC says they are suing Binance.com over BTC, ETH, and LTC being commodities 😀, so: a. The lawsuit may be dismissed because BTC, ETH, and LTC are not commodities, but securities, which CFTC cannot sue over. b. If both sides go to court, the judge may accept BTC, ETH, and LTC as commodities 🤷♂️
As you know, CFTC and SEC are currently fighting for control over cryptocurrencies. This is also an interesting move by the CFTC.
Here is a lens-style translation of the original text.
